Our dear friend and founding partner, Walter H. Peake, III, passed away unexpectedly on April 3,2019. Walt was a masterful trial lawyer specializing in the defense of medical professionals. He was known not just for his keen intellect, his skillful advocacy, and unyielding concern and devotion to his clients, but also for his quick wit, his engaging personality and his contagious love of life.Possessed of a self-deprecating sense of humor and an infectious laugh, Walt could be counted on to brighten any gathering with a great story or perhaps even a song bringing levity and a smile to all.

Walt was a lawyer’s lawyer. He embraced defending his clients, regardless of how difficult the challenge,and passionately advocating their cause. His immense legal ability and accomplishments earned him the respect and admiration of his clients, his peers, and the tribunals before whom he appeared. He loved the intellectual stimulation of his chosen career and took particular pleasure in mentoring young lawyers and watching their careers grow and successfully mature. He was especially proud of the firm he helped found and of those who practiced with him, always quick to credit the efforts of others. His love and devotion to his firm and his clients was only surpassed by his unyielding love of and devotion to his wife Nancy and children Meredith, Kathleen and John.

We were privileged to call Walt our partner and blessed to call him our friend. We have lost a dear and trusted colleague and the profession has lost one of its brightest and best. We extend our heartfelt sympathy to Nancy, Meredith, Kathleen, John and the entire Peake family. Rest in Peace – Gone Far Too Soon.

Attorneys Peake and Workowski Present at VADA Meeting

Frith Anderson + Peake PC attorneys Walt Peake and Sean Workowski presented an ethics CLE at the 2018 Annual Meeting for the Virginia Association of Defense Attorneys in Williamsburg, Virginia on October 12. Keeping with the VADA’s 50th Anniversary Annual Meeting theme of “Looking Back & Moving Forward,” Peake and Workowski addressed ethical issues in the changing practice of law for the insurance defense lawyer as well as ethical conundrums commonly—and not so commonly—faced by all trial attorneys. The topics addressed included effective representation while controlling costs, ethical obligations in mediation and settlement conferences, the potential crossroads between the unauthorized practice of law and “paralegal tasks,” and jury research in the social media age.

Walt is a founding partner of FA+P. He specializes in medical malpractice defense and the representation of healthcare professionals in licensing, board and privileges matters, as well as other healthcare matters. Sean’s primary focus is civil litigation, particularly in the areas of insurance defense, transportation, insurance coverage, products liability, premises liability and subrogation.

FA+P’s Medical Malpractice Team Prevails in Maternal Death Case

Frith Anderson + Peake attorneys, Walt Peake and Matt Kelley, successfully struck the plaintiff’s case in a recent City of Charlottesville wrongful death medical malpractice case. At the close of the plaintiff’s evidence, the defense argued that the plaintiff’s experts failed to provide sufficient causation evidence demonstrating that the mother’s death had been caused by any of the alleged breaches of the standard of care or that any action could have prevented the death. The Court carefully considered the evidence and found, with the guidance of some recent Virginia Supreme Court case law, that the plaintiff had not met his burden of proof. On the third day of a five day jury trial, the Court granted the defendants’ motion to strike concluding the case in favor of the defendant obstetrician/gynecologist and the defendant maternal fetal medicine specialist.

FA+P’s Medical Malpractice Team Earns Another Defense Verdict

Frith Anderson + Peake attorneys, Walt Peake and Matt Kelley, earned a defense verdict in the Roanoke City Circuit Court in Roanoke, Virginia. At the close of a five day trial, the jury found in favor of the defendant physician who the plaintiff claimed had left hemostatic agent in her cervical spine that swelled to cause spinal cord compression. The jury heard evidence from defense experts proving that the plaintiff’s claimed injuries were not caused by the defendant’s surgical actions. Under the defense theory, the plaintiff’s claimed injuries were caused by a series of hypotensive episodes during surgery not the actions or inactions of the defendant physician.

FA+P’s Medical Malpractice Team Earns a Defense Verdict

Frith Anderson + Peake attorneys, Walt Peake and Matt Kelley, earned a defense verdict in the Circuit Court for Campbell County in Rustburg, Virginia. At the close of a three day trial, the jury found in favor of the defendant physician assistant and his employer who the plaintiff claimed improperly irrigated an abdominal puncture wound with Hibiclens. The jury heard evidence from defense experts proving that the irrigation technique was proper and that the plaintiff’s claimed abdominal wound was caused by trauma and infection induced fat necrosis not a chemical burn.

FA+P’s Medical Malpractice Team Earns a Defense Verdict

Frith Anderson + Peake attorneys, Walt Peake and Matt Kelley, recently earned a defense verdict in the Circuit Court for the City of Charlottesville in Virginia. At the close of a three day trial, the jury found in favor of the estate of a deceased maternal fetal medicine specialist who the plaintiff claimed improperly inserted a suture into her bladder. The jury heard evidence from defense experts proving that the suture was not placed in the bladder during surgery, but rather eroded over time following surgery.

FA+P Attorneys speak at 2017 Virginia Association of Defense Attorneys’ Annual Meeting

Attorneys Walt Peake, Sean Workowski and Andrew Gerrish were speakers at the 2017 Virginia Association of Defense Attorneys’ Annual Meeting in October 2017.

Walt, Sean and Andy presented on Ethics During Trial. This ethics presentation outlined recent changes to Virginia Rules of Professional Conduct 1.6 and 3.3 regarding the duties of confidentiality and candor towards the tribunal. During this ethics CLE, Sean and Walt also discussed ethics questions that had arisen in their practices; hypothetical ethics questions; and the application of the rules, legal ethics opinions, and case law to those scenarios.

Sean Workowski also served as a panel member for a discussion on defending cases involving traumatic brain injuries titled TBI 101: Investigating and Defending TBI Cases. Andy also served on the VADA’s Annual Meeting committee.

Walt is a founding member of FA+P. He specializes in medical malpractice defense and the representation of healthcare professionals in licensing, board and privileges matters, as well as other healthcare matters.
