Frith Anderson + Peake attorney, Matt Kelley, earned a defense verdict in the United States District Court for the Western District of Virginia in December 2018.  At the close of a one day trial, the Court found in favor of the defendant physician. The plaintiff claimed that the defendant acted with deliberate indifference to reported knee complaints when he recommended conservative treatment instead of an MRI study.  Plaintiff claimed this denial of his desired MRI resulted in later diagnosed ACL and meniscus tears.  The Court heard evidence from the defense proving that the care provided was medically appropriate and that the plaintiff’s claimed injuries were not caused by the defendant’s actions.
